ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH take protection of your personal data very seriously and adhere closely to the provisions of Data Production Regulations. It is necessary to collect, process and use personal data of participants.
Participation
Persons wishing to participate must complete and submit the necessary application form for registration as an entrant. Participants have no legal claim to registration. Submission of the duly completed application form confirms the Participants consent to collection and electronic storage of his/her personal data and for the duration of the competition by ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH and other entities involved in organization.
Newsletter
Participants’ personal data will, subject to their consent, be used by ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH for circulation of newsletters and attractive offers by e-mail and/or print mail.
The application form contains the following declaration signifying the applicant’s consent to the use of personal data:
“I hereby authorize ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH to send me newsletters and attractive offers by e-mail and/or print mail. This authorization is issued subject to the proviso that it can be withdrawn at any time, effective as from date of receipt of notice of withdrawal.”
Withdrawal of consent
This authorization to use personal data and send newsletters by mail can be withdrawn at any time, effective as from date of receipt of notice of withdrawal. Simply send the notice of withdrawal by e-mail to: info@ performance2.info.
ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH will on request give a competition entrant full details of his/her personal data filed in their electronic storage system. This service will be provided at any time free of charge.
The General Data Protection Regulations of ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich EIBACH GmbH will also apply. In the event of discrepancies between the general data protection regulations and the special data protection regulations set out above, the special data protection regulations shall take precedence.
ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH are jointly raffling the following prize:
1 Eifel-weekend: After installing a B12-Pro-Kit or a B12-Sportline suspension system to your car (or project-vehicle for international winners) you will experience the dream curves of the Eifel area for one weekend (17.-19.08.2012). This also includes the DTM race at the Nürburgring, a road safety training and a two night stay at a hotel (breakfast included).
As we will have no advance information on the prizewinner’s vehicle, we reserve the right to provide prizewinners with an available, alternative suspension system.
Entrants to the competition must accept the following conditions:
Clause 1 Qualification as entrant
- Entrants must be not less than 18 years of age and have their principal place of residence in the Federal Republic of Germany. In case of doubt on compliance with the foregoing qualifications, the onus of proof shall lie with the entrant.
- Applications to enter the competition can be filed online at www.performance2.info by completing and sending the application form. ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH will immediately acknowledge receipt of applications by e-mail. The entrant has only to click on the link contained in this e-mail to confirm participation in the competition.
- In order to enable processing of applications, we shall require entrants’ personal data, which will be stored electronically only for the duration of the competition. See below for information on applicants’/entrants’ right to withdraw consent to the use of personal data received in connection with the competition. The closing date for applications is 30 June 2012.
Clause 2 Refusal of applications
ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH reserve the right to refuse applications without stating reasons. No entrant is entitled to claim the right to participate in the competition. ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH also reserve the right at all times to exclude entrants from the competition even after their acceptance. This applies especially in cases of violation of the competition rules, use of technical aids or other manipulative aids. In any such cases, ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH shall be entitled to disallow the prize award or, where applicable, to demand return of the prize. This shall also apply in cases where entrants make untrue statements relating to their personal data. Employees (and other family members) of ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH, of the competition sponsors, of other entities involved in organization of the competition are excluded from participation in the competition.
Clause 3 Notification of prizewinners, prize delivery
- Prizewinners will be determined by drawing lots. Lots will be drawn not more than four weeks from the closing date for applications. Prizewinners will be notified by ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH.
- Prizewinners will not be entitled to claim cash payment in lieu of the stated prize. Prizes are not transferable.
- Prizewinners will be liable for payment of all consequential costs arising from or in any way connected with the prize. ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH disclaim any liability whatsoever for such costs.
- Should it prove impossible to deliver the prize to the prizewinner without incurring unreasonably high expense, ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH reserve the right to use an appropriate procedure to choose an alternative prizewinner.
- Should a prizewinner fail to respond to the notification sent by ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH within four weeks of date of dispatch, his/her claim to the prize shall lapse irrevocably.
- Prizes will be delivered free of charge within the Federal Republic of Germany. Customs duties and shipping charges for delivery of a prize to a destination outside Federal German territory shall be borne by the prizewinner. The place of performance of contract is the domicile of ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH, even in cases where prizewinners bear the
- shipping charges.
- Should reasons for which the prizewinner is responsible make it impossible to deliver the prize within four months from date of dispatch of the prize notification, his/her claim to the prize shall lapse irrevocably.
- Prizewinners are not entitled to claim a prize exactly identical to the prize offered. The article advertised as the competition prize will not necessarily be exactly identical to the prize actually won, and can differ, for example, in color, model etc. ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH are entitled to select as prize an article of equivalent and similar type and quality to the advertised prize.
- Only one prize will be awarded to any individual entrant or household.
- The place of performance for delivery of the prize offered for this competition is the domicile of ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH.
Clause 4 Premature termination of competition
ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH reserve the right to discontinue or terminate the competition without notice and without stating grounds, and are, in particular, entitled to invoke this option either for technical reasons, for example, viruses in the computer system, manipulation of or defects in hard- and/or software, or for legal reasons, for example, if these make it impossible to ensure that the competition can be held under fair conditions. Should any such premature termination of the competition be the result of actions perpetrated by an entrant, ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH reserve the right to demand from that entrant adequate compensation for the loss incurred.
Clause 5 Liability
- Handover of the prize to the prizewinner constitutes complete fulfillment of ThyssenKrupp BILSTEIN Tuning GmbH’s and Heinrich Eibach GmbH’s obligations arising from and in connection with the competition.
- The liability of ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH is limited to willful act or gross negligence, or through minor negligence leading to breach of cardinal obligations. This limitation of liability does not apply to actions resulting in death, bodily or other health injury or to claims filed under the Product Liability Act.
- All statements in connection with the competition are made without guaranty, in particular, with regard to publication of names of prizewinners. Any claims relating to the prizes must be filed directly by prizewinners with ThyssenKrupp BILSTEIN Tuning GmbH and Heinrich Eibach GmbH in their capacity as source of the prize.
- ThyssenKrupp BILSTEIN Tuning GmbH und Heinrich Eibach GmbH disclaim all liability for technical breakdowns resulting in non-availability of prizes, except in cases where this is caused by willful act or gross negligence.
Clause 6 Miscellaneous provisions
Recourse to courts of law is excluded. The competition is governed solely and exclusively by Federal German law. Should any individual provisions contained herein prove or subsequently become invalid, this shall not affect the validity of the remaining provisions.
